A New Zealand judge has granted bail to two executives of MegaUpload.
Bram van der Kolk, 29 year old Dutch national, and German Finn Batato, 38, who were arrested last Friday along with MegaUpload’s founder, Kim “Kim Dotcom” Schmitz were freed on bail late Thursday evening.
A bail hearing for another MegaUpload associate, Mathias Ortman, is continues in New Zealand.
The freed duo are required to submit to strict bail conditions including electronic monitoring and a temporary ban from using the Internet.
“I am satisfied that the risk of flight here is minimal and such risk as remains can be met by the imposition of strict bail conditions including electronic monitoring,” Judge David McNaughton said in a written judgment.
MegaUpload’s executive in chief has been denied bail as the judge believes Mr. Schmitz is a flight risk.
Mr. Schmitz’s lawyer has announced that he intends to appeal this decision, and is scheduled to appear in court on February 22.
