This is insane really. Obviously they don't care much about their customers. I think you might be going in the right direction by trying to fix to problem yourself because it seems that Diamond won't do it for you. I had some problems with a BFG 6800 a while back but I stopped after 2 RMA and bought another card but doing so means that you incur a money lost.

Depending on when you originally purchased the first card, you could return it to the original place of purchase instead of always RMA-ing it directly to Diamond. Out of curiosity, how much did you 3870X2 cost and where did you buy it from?
Either way, you ought get an aftermarket cooler especially if Diamond won't reply to your RMA.
Wait a minute, I don't think there are any aftermarket coolers out for the 3870X2, only waterblocks...
Perhaps you can find a stock 3870 cooler and strap it on to your 3870?
