^ yes that's very good news to hear, but it was said before that they will be coming out of pocket on this which is bull they should be able to counter cue for losts/sales and damages do to said lawsuit

Profiteering via the legal system should be illegal. This has nothing to do with protecting anything or recovering lost revenue, this is some ahole's idea of a way to make some cash. Imo if the party making the claim loses the case or it's thrown out of court, they should be heavily fined and pay all legal costs.
