Default Sony PS3's new EULA

I never go online with my PS3 anymore, but apparently there was a recent update which carries a new ToS/EULA in which it states you will not be allowed to take part in any class-action lawsuit against Sony. You can however opt out of this... by sending a letter to Sony. There is no way to do this electronically.

Stay Classy

Mandatory PS3 update removes right to join in a class-action lawsuit

Quote:
ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL LEGAL ACTION, UNLESS BOTH YOU AND THE SONY ENTITY WITH WHICH YOU HAVE A DISPUTE SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE ARBITRATION. THIS PROVISION DOES NOT PRECLUDE YOUR PARTICIPATION AS A MEMBER IN A CLASS ACTION FILED ON OR BEFORE AUGUST 20, 2011.

Yeah I got tricked into agreeing to this a few days ago. Sneaky bastages.

Thread already going on this with some discussion about legality: New SONY TOS Blocks Class Action Suits

You can opt out, it requires a notice in writing however.

Yup, no more PS3 game purchases for me. I'm just going to stick to using the PS3 as a BD player.

I fail to see why this is an issue or anyone even cares. Sure Sony is cheesy for what they have done with the PS3 and what they continue to do, but it isn't likely to change and is only gonna continue. I click them and never even remotely care to read them because I just don't care. This will only cause less than 1% of the people buying/owning them grief.

Seriously? Who cares. Just use your damn machine and have fun it. The EULA isn't going to change anything for anyone unless your gonna be stupid with your PS3.

It's the principle that counts though.
I guess if the PS3 was the only console I had I would bend over and take it, but since I've got a 360 and prefer it anyway, I'm not going to support Sony anymore and buy any games for the PS3.
