Default RMA for 2nd hand CPU

I purchased an i3 2120 in the BST here recently, and it just bought the farm. Luckily the seller is being a stand-up guy and is willing to help with the RMA process. How should we go about doing this RMA? If I do the RMA with his original receipt from Memory Express, would that be okay.. considering that I have a different name and address? Also should it go back to Intel.. or Memory Express?

Unless he has the express replacement, you should be dealing with Intel. And it was awfully nice of your "brother-in-law" to give you the CPU and receipt for your birthday.

Intel for the return. Either mail it in with the original owners return mail address and have them mail the new CPU to your, or go with the fact that your "family" bought it for you.
