He's not actually selling software at all, he's including it for free, he's just charging and absurd amount for pocket lint and most likely stale dare candy. I'd say this may end up warranting a rule change in the BST as this is an exploitation of the current statement of the rules

For the record, FiXT did ask me about this, and I figured it was ok as it was part of a 4-pack someone backed out and stuck him with. However, I fully expect a negative iTrader if the purchaser doesn't receive his candy and lint. :)

No it's not against Steam's EULA as this looks like a giftable key. But HWC has their own BST rules about software regardless of EULAs me thinks.

Just in a quick response as I figured it would come up.

The major reason we don't allow the sale of software, cd key's etc. is primarily for buyer/seller protection but also due to the EULA/TOS legal confusion. The fact is that software vendors attempt to get around allowing you actually owning the product you bought and paid for, by including a tricky licensing agreement in their sale terms, whereby you only license YOUR software from them, not own it. This specifically restricts the sale or transfer of any form of software under copyright law.

Legally, thanks to Vernor v. Autodesk, the first sale principle has been upheld meaning that despite EULA/TOS you are in fact able to legally resell your software, even if they only "license" it to you, but that is another story for another day.

The Steam agreement does specifically allow for the gifting of one of the "keys" for free to other people in their 4-packs. The thread abides by both Law, Steam's EULA/TOS and HWC's (currently ;) ) rules. Because nearly all other software/programs do NOT specifically allow for the transfer of the key - even for free - it would not fly.
