yea you should rate him a negative imo, for me a failed memtest = memory is broken (not working), so basically he just sold you a piece of worthless junk that has 'ddr3' label on it

but really do make sure it actually fails memtest for sure before giving him the negative

Easy on the negative talk, fellas. Maybe the RAM got damaged in transit (Canada Post has been known to be a little rough on it's packages). Give him a chance to respond, he does have 14 positive transactions so it's not like he's some scammer.

You don't give negative feedback until you've tried to rectify the issue with the seller.

Absolutely....give the seller a chance to redeem himself. I once sold a virtually new, barely used cpu to a fellow HWC'r that failed when he tried some gaming on it. I arranged the rma and covered the shipping to the rma center. It took a bit but I got it resolved to the buyers satisfaction.

hm dead crucial...surprising...the only point to have crucial memory is for benching...bench remove of the computer and RMA time.
