Can someone please clarify whether or not Steam games that can be gifted, fall under the category of software or intangible items?? (I have two Torchlight 2 gifts that want to sell off for cheap.)

Hrmmmmmm.... technically no they can't be sold. The only games / software which we allow to be sold are console games.

OTOH, I haven't seen any complaints when folks put up a "I'm doing a bulk buy, does anybody want in?" threads for steam games (there have already been several for torchlight IIRC).
