This is my collection of ps2 games that I want to get rid of.
I must ask that the buyer has to pay the shipping though.

Software is typically a term coined by definition of specifically a computer application, though consoles games may fall under the title as well if you dig deep enough.

The reason PC games are banned from resale is the fact that manufacturers/develops simply DO NOT ALLOW PC games to be resold, heck, many of they don't allow brand new games to be sold unless you are an authorized dealer. The second portion of the BST rule comes from the hassle of CD Keys, which almost always accompany PC Games. When was the last time you plugged in a CD Key on your PS2, or Xbox game?

Take the time to read the EULA of any PC Game and it restricts resale. Console games on the other hand, have no such limitations.

There are active communities SUPPORTED and endorsed by Sony, Microsoft and Nintendo themselves, which deal with the resale of second hand games. There are businesses such as EB Games, Gamestop, and others - who primary business is the resale of USED console games.

I quickly scoured the net, read EULA's from popular titles and unquestionably there is nothing that restricts the resale of CONSOLE games.
Given that there are no CD Keys, and it is not restricted - Arguably a console game is no different from any other piece of equipment.

When you purchase a console game - you own the actual product, unlike PC games where you have merely purchased a license to play the game. There is a HUGE difference with what type of restrictions are placed on the two

I suggest brushing up on the first sale doctrine which sets precedent for the resale of copyrighted materials.


The mods are discussing the matter with the big kahuna - but I figured shayan should receive the benefit of the doubt before action was taken. I feel shoot first think later is only for the military.



P.S. Obviously as things stand - the resale of pirated materials, PC, console or anything of the like is forbidden no matter what.

Curious though since you can buy used PC games off of redflagdeals and ebay? What is the difference here? I mean it's not illegal? Who cares what the manufactures say.

The simple answer is, it is not illegal, merely not supported and poo poo'd by the developers. The US Supreme Courts have ruled that EULA's with the "you are only licensing this product clause" for the restriction of game sales, are not binding (for now)( see Timothy S. Vernor v. Autodesk Inc for more info).

So legally it is a non issue. Hardware Canucks merely wants to avoid the hassles associated with software selling as there is a much larger risk with fraud and the potential for problems associated with PC applications. It is not just a plug and play routine like console games.

Hopefully that should summarize it.
