Many are retail cards actually. They are however provided to reviewers for the purposes of testing and since they are not actually PLACED in the retail channel, there is no documentation of them being sold....hence, no paper trail, no warranty.
Again, that isn't to say Mr. Sky can't talk to the manufacturers if something goes bump in the night. ;)
